General Purchase Terms & Conditions

I understand that my purchases through the Boston Mills/Brandywine website are nonrefundable and nontransferable.  I understand that all events at Boston Mills/Brandywine are held rain or shine, and that no makeup events will be available unless otherwise stated at the time of purchase.

I understand that skiing/snowboarding involves inherent danger and other risks of INJURY and DEATH.  “Inherent dangers and risks of skiing” means those dangers or conditions which are an integral part of the sport of skiing, including but not limited to snow conditions as they exist or may change, collisions with natural objects or man-made structures and their components; variations in steepness or terrain, whether natural or as a result of slope design, snowmaking or grooming operations, and collisions with other skiers. I hereby agree to freely and expressly assume and accept any and all risks of injury while engaging in the sport of skiing/snowboarding at Boston Mills/Brandywine. I further agree to defend and indemnify the Resort for any loss or damage, including claims or lawsuits for personal injury, loss of consortium, loss of services, death, and property loss and/or damage, relating to my, my spouse’s or my child’s participation in skiing/snowboarding at the Resort. I release Boston Mills/Brandywine from any and all responsibility or liability for injuries or damages while I am skiing/ snowboarding at Boston Mills/Brandywine and I agree not to make any claim against Boston Mills/Brandywine for injuries or damages relating to skiing/snowboarding as noted by my signature below. 


Season, Pick-A-Day and Summit Pass Terms & Conditions

I understand that skiing/snowboarding involves inherent danger and other risks of INJURY and DEATH.  “Inherent dangers and risks of skiing” means those dangers or conditions which are an integral part of the sport of skiing, including but not limited to snow conditions as they exist or may change, collisions with natural objects or man-made structures and their components; variations in steepness or terrain, whether natural or as a result of slope design, snowmaking or grooming operations, and collisions with other skiers. I hereby agree to freely and expressly assume and accept any and all risks of injury while engaging in the sport of skiing/snowboarding at Boston Mills/Brandywine. I further agree to defend and indemnify the Resort for any loss or damage, including claims or lawsuits for personal injury, loss of consortium, loss of services, death, and property loss and/or damage, relating to my, my spouse’s or my child’s participation in skiing/snowboarding at the Resort. Season & Pick-A-Day Pass Terms & Conditions
1. I understand that there are NO REFUNDS.
2. I understand that this pass is non-transferable and is for the use of the designated passholder only. If I am caught giving my pass to someone else to use, the pass will be voided for the remainder of the season. This is fraud.
3. I understand that the passcard does NOT serve as admission onto the snow. My passcard must be presented at the BMBW ticket windows in order to receive my weekly snow/lift ticket, or to use one of my value passes.
4. I understand that the passholder (regardless of age) must be the one to present the passcard at the ticket windows to receive the daily or weekly Snow Pass, or use a value pass.
5. I understand that if I misplace or lose my pass, there is a $25 replacement fee. I may be responsible for the use of the pass between the time when it is misplaced/lost, and the time that its absence is reported to BMBW.
6. I understand that safety is very important, and that this pass may be revoked by Boston Mills/Brandywine for violation of safety or company rules.

Summit Pass Terms & Conditions

1. I understand that there are NO REFUNDS.
2. I understand that this pass is non-transferable and is for the use of the designated passholder only. If I am caught giving my passcard to someone else to use, the pass will be voided for the remainder of the season. This is fraud.
3. I understand that the Summit passcard does NOT serve as admission onto the snow. My passcard must be presented at the BMBW ticket windows in order to receive my daily snowpass.
4. I understand that the passholder must be the one to present the passcard at the ticket windows to receive any snowpass privileges.
5. I understand that if I misplace or lose my passcard, there is a $25 replacement fee. I may be responsible for the use of the passcard between the time when it is misplaced/lost, and the time that its absence is reported to BMBW.
6. I understand that safety is very important, and that this pass may be revoked by Boston Mills/Brandywine for violation of safety or company rules.
7. I understand that Summit Passes do not include any additional snowpasses, lessons, or snow tubing tickets at Polar Blast.

 


SnowCard Terms & Conditions

Lost, stolen or misplaced cards must be reported immediately to Guest Services in the Info Office, either in person or by calling 800-U-SKI-241. Custom SnowCards that were printed with a name on them can be reprinted for a fee. The cardholder may be responsible for unauthorized use of the card. Gift cards without an assigned name are transferable. They have no tracking method build into them, and are considered the same as cash if lost or stolen. Cash cannot be withdrawn from any SnowCard account. The cardholder is responsible for maintaining a valid SnowCard in proper working condition. The Snow Card is the access device for the member's account. The card must be presented at the time of purchase and shall be the only means of accessing the participants account.

SnowCards expire 5 years from the date that funds were last loaded onto the card. The SnowCard is an in-house, private label concept. It places a debit account on your membership ID card or on an unnamed gift card. The account is activated once funds have been deposited with Boston Mills/Brandywine. The SnowCard eliminates the need to carry cash, checks, or credit cards and offers value.


Club Program Terms & Conditions

I understand that skiing/snowboarding involves inherent danger and other risks of INJURY and DEATH.  “Inherent dangers and risks of skiing/snowboarding” means those dangers or conditions which are an integral part of the sport of skiing/snowboarding, including but not limited to snow conditions as they exist or may change, collisions with natural objects or man-made structures and their components; variations in steepness or terrain, whether natural or as a result of slope design, snowmaking or grooming operations, and collisions with other skiers/snowboarders.  The undersigned skier/snowboarder and parent or guardian of said skier/snowboarder agree to assume any and all risks inherent to or associated with the sport of skiing/snowboarding.

If undersigned is renting equipment from Boston Mills/Brandywine, undersigned accept for use said equipment to be supplied by Boston Mills/Brandywine and accept full responsibility for the care of this equipment.  Undersigned has made no misrepresentations to Boston Mills/Brandywine regarding this user’s height, weight, age or skier type. Undersigned understand that the sport of skiing/snowboarding and the use of ski/snowboard equipment involve a risk of injury to any and all parts of the skier/snowboarder’s body. Undersigned hereby agree to freely and expressly assume and accept any and all risks of injury to the user of this equipment while skiing/snowboarding.

Undersigned understand that the ski equipment being used forms a part of or all of a ski-boot-binding system which will NOT RELEASE at all times or under all circumstances and that it is not possible to predict every situation in which it will or will not release, and that its use cannot guarantee this skier’s safety or freedom from injury while skiing. Undersigned further agree and understand that this ski-boot-binding system may reduce but does NOT ELIMINATE THE RISK of injuries to the lower portion of the skier’s leg. However, undersigned agree and understand that this ski-boot-binding system may NOT reduce risk of injuries to this user’s knees or any other parts of this user’s body.  Undersigned are also aware that the snowboard boot/binding system IS NOT DESIGNED OR INTENDED TO RELEASE. Undersigned hereby freely agree to assume and accept any and all known and unknown risks of injury while using this equipment.

To the fullest extent allowed by law, the undersigned agree to release Boston Mills/Brandywine Ski Resort, its employees, officers, directors, instructors, ski patrollers, agents and owners, from any and all responsibility of liability for injuries or damages to the user of said rental equipment, or to any other person. Undersigned agree NOT to make a claim against or sue Boston Mills/Brandywine Ski Resort, its employees, officers, directors, instructors, ski patrollers, agents and owners, for injuries or damage relating to skiing/snowboarding and/or the use of said ski/snowboard equipment.

We the undersigned hereby agree to accept the terms and conditions of this contract. This document constitutes the final and entire agreement between Boston Mills/Brandywine Ski Resort and the undersigned. Boston Mills/Brandywine Ski Resort, itself, provides NO WARRANTIES, express or implied, and said equipment is accepted “as is.” We the undersigned have carefully read this agreement and release of liability and fully understand its contents. We, the undersigned, are aware that this is a release of liability and a contract between us and Boston Mills/Brandywine Ski Resort and we, the undersigned, sign it of our own free will. This document is a legally binding contract which supercedes any other agreements or representations by or between the parties and which is intended to provide a comprehensive release of liability, but is not to assert any claims or defenses which are prohibited by law.

Boston Mills/Brandywine Management will revoke skiing/snowboarding privileges (Snow Passs or season passes or school tickets) when a skier/snowboarder is identified as having violated any of the Responsibility Code, printed in this brochure. The code in this brochure is a partial list. Be safety conscious and courteous at all times. When a skier/snowboarder has violated any of the responsibilities in the code or others posted at the ski resort, a member of the Ski Patrol or other  designated employee will advise the skier/snowboarder of the violation in a firm but courteous manner, including how the skier/snowboarder may have endangered him/herself or another skier/snowboarder. The employee will then:    1. Issue a warning ticket. 2. Take the skier/snowboarder to management and provide management with information about the violation.
Management will then, based on the seriousness of the violation and any previous violation, inform the skier/snowboarder of the period of revocation or indefinitely suspend the violator’s skiing/snowboarding privileges. A record of the situation, including the skier/snowboarder’s name, staff member involved, date, nature of the violation and action taken will be made by management and retained in the office. Boston Mills/Brandywine reserves the right to suspend or revoke ski/snowboard privileges for any reason. 


Lesson Program Terms & Conditions

I hereby agree to freely and expressly assume and accept any and all risks of injury while engaging in the sport of skiing/snowboarding at Boston Mills/Brandywine. I further agree to defend and indemnify the Resort for any loss or damage, including claims or lawsuits for personal injury, loss of consortium, loss of services, death, and property loss and/or damage, relating to my, my spouse’s or my child’s participation in skiing/snowboarding at the Resort. I release Boston Mills/Brandywine from any and all responsibility or liability for injuries or damages while I am skiing/ snowboarding at Boston Mills/Brandywine and I agree not to make any claim against Boston Mills/Brandywine for injuries or damages relating to skiing/snowboarding as noted by my signature below.

Additional Lesson Terms & Conditions
1. I understand that there are NO REFUNDS.
2. I understand that I may not misrepresent myself/my child, including altering a date of birth, in order to participate in a lesson program. This is fraud.
3. I understand that, if my lesson package includes a “lift” portion, I will receive a necktag that serves as my access to the snow.  I agree to follow the terms of its use, and I will not allow anyone else to use my necktag.
4. I understand that if I misplace or lose my necktag, there is a $25 replacement fee.
5. I understand that safety is very important, and that my lesson program participation may be revoked by Boston Mills/Brandywine for violation of safety or company rules.
